Anton Wilhelm Amo (c. 1700 – c. 1750) – born in West Africa, enslaved, and then gifted to the Duke of Braunschweig-Wolfenbüttel – became the first African to earn a Ph.D. in philosophy at a European university. He went on to teach philosophy at the Universities of Halle and Jena. On the 16th of April, 1734, at the University of Wittenberg, he defended his dissertation, De Humanae Mentis Apatheia (On the Impassivity of the Human Mind), in which Amo investigates the (...) logical inconsistencies in René Descartes’ (1596 – 1650) res cogitans (mind) and res extensa (body) distinction and interaction by maintaining that (1) the mind does not sense material things nor does it (2) contain the faculty of sensing. As a Catholic nun, to suggest Jacqueline Pascal as autonomous might at first glance seem contradictory. We show that her moral deference to the divine is not at all forfeiting her autonomy, but that aligning her own law with God's law is to align her own law with rationality itself, that is, the laws of nature. Her theoretical structure begins with a theory of virtue—viz., how and to whom we have an obligation to be moral. For her, acting in accordance (...) with cultural restrictions or following church orders against her own conscience would be living by the laws of another and so not acting autonomously. Pascal would not live by other's laws, regardless of whether her actions conform to the categories by which society expected her to act. The framework for her laws laid in Pascal's understanding of self-governance: if she wants to act virtuously then she must autonomously follow God's law by making it her own through the sentiments of her heart. Thus, she cannot live by the laws of men, but by the laws of her human nature and in alignment with a rightly ordered universe, that is, God's law, which we show parallels with a Stoic framework of autonomy. The ethos of Justin Smith’s Nature, Human Nature, & Human Difference is expressed in the narrative of Anton Wilhelm Amo (~1703-53), an African-born​ slave who earned his doctoral degree in Philosophy at a European university and went on to teach at the Universities of Jena and Halle. Smith identifies Amo as a time-marker for diverging interpretations of race: race as inherently tethered to physical difference and race as inherited essential difference. Further, these interpretations of race are fastened to the discourse (...) of science and human diversity within modern Europe. Smith’s thesis maintains that the rise of the concept of race in philosophy begins with a divorcing of the soul from human nature and a movement to a naturalistic classification of human beings through taxonomies (e.g. botany, mineralogy and zoology), which dissolved into this dichotomy: an essential difference between people of reason and people of nature. The U.S. Supreme Court's seminal 1978 Bakke decision, now 25 years old, has an ambiguous and endangered legacy. Justice Lewis Powell's opinion provided a justification that allowed leaders in medical education to pursue some affirmative action policies while at the same time undermining many other potential defenses. Powell asserted that medical schools might have a "compelling interest" in the creation of a diverse student body. But Powell's compromise jeopardized affirmative action since it blocked many justifications for responding to increases (...) in political opposition and legal challenges. The Bakke decision and itsmoral background and legal legacy are traced and analyzed. Despite recent legal setbacks, the framework sketched by Powell can be used to defend diversity inmedical education bothmorally and legally as a "compelling state interest." Because trust is a central component of the physician-patient relationship and a prerequisite to the profession's ability to provide effectivemedical care, the state has a compelling interest in training physicians with whom patients can feel comfortable and safe if the population is distrustful; underserved; faces significant discrimination in the allocation of benefits, goods and services and affirmative action programs would be likely to promote their trust in the system. Similar narrowly-tailored arguments could be used in other professions and for other groups. Bakke is an important background for the pending Grutter case. (shrink)

David Lewis championed a counterfactual account of causation, but counterfactual accounts have a notoriously difficult time handling cases of late preemption. These are cases in which we still count one event as the cause of another although the effect does not depend on the cause in the way taken to be necessary by the account. Lewis recognized these cases, but they have been shown to be problematic even for his final analysis of causation, the Influence Account. In this (...) paper, I show how these cases led to and remain a problem for Lewis’s Influence Account, and I give a new counterfactual account available to a Lewisian that can handle late preemption cases. What is crucial to my account is that a cause not merely has counterfactual influence over its effects, but that the cause has influence of the right kind. I conclude by arguing that even if problems remain with this account, they will not be problems of late preemption, and the problems stemming from other kinds of cases will be no worse for my account than for other counterfactual accounts. The Oxford English Dictionary says that a rite is ‘a formal procedure or act in a religious or other solemn observance’. The word comes into English through the French rite from the Latin ritus . Its original meaning escapes etymologists; and this is a mixed blessing, for we neither can nor must attempt a retrieval of its hidden roots. We are told by respectable etymologists that the word is associated from earliest times with Latin religious usage, but that even in (...) the early Latin it was already extended to ‘custom, usage, manner or way’ of a non-religious sort. [Lewis and Short, A Latin Dictionary .] So, too, in modern languages the terms ‘rite’ and ‘ritual’ have specifically religious meaning, but they are also used in social and cultural settings that we would not call religious. What first strikes us about the terms ’ and ‘ritual’ is an emphasis upon a certain formality, upon a regular and stable way in which an action or set of actions is to be performed. A ritual is more than a formalism, however, since there are formalisms that are not rites, such as the logical rules for making a valid argument. Moreover, the term is frequently associated with the terms ‘myth’, ‘symbol’ and ‘faith’. These, too, are primarily religious, but are also extended to non-religious contexts. Indeed, there seems to be a network of such terms whose usage touches upon some extraordinary quality in things. Like them, the term ‘ritual’ shares both a wide variety of meanings and a certain hint of impropriety. The variety of ritual forms is notorious, ranging from the most sacred religious liturgies to the absurdities of a fraternity initiation; and the impropriety of the term breaks out whenever we brand a certain action ‘ritualistic’, just as we sometimes refer slightingly to an assertion, saying it is ‘mythical’, ‘merely symbolic’ or ‘credulous’. Thompson addresses the role that traditions and values play in shaping change and in helping us to understand its implications. He challenges the idea that the enormous changes in contemporary national and international life have rendered the consideration of traditions and values obsolete. Thompson’s purpose is to illuminate the problems we face and to set forth general principles directed toward an informing theory on traditions and (...) values as they affect politics and diplomacy, while at the same time warning of the pitfalls and limitations of theory. In the first section of this book, Thompson draws on classical and Judaeo-Christian traditions in defining the relationship between philosophy, religion, and politics. He then examines the application of abstract values to such political realities as national interest, and goes on to consider the question of moral values in international diplomacy and politics. In a series of case studies, Thompson reflects on human rights, disarmament and arms control, and human survival. Maintaining that the implementation of traditions and values is sometimes uniquely the task of the American presidency, he studies the administrations of four postwar presidents—Dwight D. Eisenhower, John F. Kennedy, Lyndon B. Johnson, and Richard M. Nixon—in the light of the executives’ attitudes toward ethics and politics. Finally, Thompson considers the implications of national decline and the breakdown of international order for the future of the United States. The vast knowledge of international affairs and the literature of politics that Kenneth W. This narrative symposium examines the relationship of bioethics practice to personal experiences of illness. A call for stories was developed by Tod Chambers, the symposium editor, and editorial staff and was sent to several commonly used bioethics listservs and posted on the Narrative Inquiry in Bioethics website. The call asked authors to relate a personal story of being ill or caring for a person who is ill, and to describe how this affected how they think about bioethical questions and the (...) practice of medicine. Eighteen individuals were invited to submit full stories based on review of their proposals. Twelve stories are published in this symposium, and six supplemental stories are published online only through Project MUSE. Authors explore themes of vulnerability, suffering, communication, voluntariness, cultural barriers, and flaws in local healthcare systems through stories about their own illnesses or about caring for children, partners, parents and grandparents. Commentary articles by Arthur Frank, Bradley Lewis, and Carol Taylor follow the collection of personal narratives. (shrink)

Implicit in C. I. Lewis's conceptual pragmatism is an account of how our ideas undergo a process of social development. Lewis's account of that process resolves a problem with Josiah Royce's theory of ideas. Royce holds that there are both sensuous and symbolic ideas. It is, however, possible for someone to have only a sensuous idea of how middle C sounds and for another person to have only the symbolic idea that middle C is 261.63 Hz. In what (...) sense, if at all, can these two persons have the same idea, namely, the idea of middle C? On Lewis's account, while ideas in individual minds are typically constituted of both sensory correlates and pure concepts, ideas are also social products that individuals inherit through education and language acquisition. This paper critically examines three key works of analytic Kantianism: C. I. Lewis, Mind and the World Order (1929), P. F. Strawson, The Bounds of Sense (1966) and Wilfrid Sellars, Science and Metaphysics (1968), focusing on their very different approaches to Kant’s Transcendental Deduction.

It has been argued repeatedly that the modern study of social and cultural evolution took its inspiration and form from Charles Darwin's Origin of Species and Descent of Man. In 1920, Robert H. Lowie observed that it was after evolutionary principles had been accepted in biology that they were applied to social phenomena, and that Lewis Henry Morgan was among the first to make the application. Sir James George Frazer, at about the same time, dated the birth of anthropology (...) from the promulgation of the evolution theory of Darwin and Wallace in 1859 and maintained that “this conception of evolution … supplies a basis for the modern science of anthropology.” Harry Elmer Barnes similarly traced the development of anthropology from the theory of organic evolution and advised the student that he “need not concern himself with the history of method in sociology before the entry of Darwinian concepts.”. Kant provided two parallel, sound proofs of mental content externalism; both prove this thesis: We human beings could not think of ourselves as persisting through apparent changes in what we experience - nor could we think of the apparent spatio-temporal world of objects, events and people - unless in fact we are conscious of some aspects of the actual spatio-temporal world and have at least some rudimentary knowledge of it. Such proofs turn, not on general facts about the world, but (...) on appreciating various fundamental regards in which our finite human cognizance depends upon the world we inhabit. The?transcendental? character of these analyses concerns identifying and appreciating various fundamental features of our finite form of human mindedness, and basic constraints upon, and prospects of, cognitive justification within the non-formal domain of human empirical knowledge. Such analyses and proofs have been developed in various ways, using distinctive strategies, not only by Kant, but also by Hegel, C.I. Lewis, Heidegger, Wittgenstein and Frederick Will. Here I examine and defend the methodological reflections required to understand, assess and appreciate such transcendental proofs, and why so few analytic epistemologists have found them persuasive or illuminating. nema. Does epistemology collapse for lack of resources other than logic, conceptual analysis and descriptions of one’s own apparent experiences, thoughts and beliefs? No, but understanding how and why not requires, Kant noted, a ‘changed method of thinking’. Some of these methodological changes are summarised in §2 in order to identify a philosophical role for thought experiments to help identify logically contingent, though cognitively fundamental capacities and circumstances necessary to human thought, experience and knowledge. This book provides an overview of some of the most important critics of “Enlightenment rationalism.” The subjects of the volume—including, among others, Burke, Kierkegaard, Nietzsche, T.S. Eliot, Wittgenstein, Heidegger, C.S. Lewis, Gabriel Marcel, Russell Kirk, and Jane Jacobs—do not share a philosophical tradition as much as a skeptical disposition toward the notion, common among modern thinkers, that there is only one standard of rationality or reasonableness, and that that one standard is or ought to be taken from the presuppositions, (...) methods, and logic of the natural sciences. The essays on each thinker are intended not merely to offer a commentary on that thinker, but also to place that thinker in the context of this larger stream of anti-rationalist thought. I take up the task of examining how someone who takes seriously the ambitious programme of conceptual analysis advocated by the Canberra School can minimise the eliminative consequences which I argue the Ramsey-Carnap-Lewis recipe of conceptual analysis is likely to have for many folk discourses. The objective is to find a stable means to preserve the constative appearance of folk discourse and to find it generally successful in its attempts to describe an external world, albeit in non-scientific terms that (...) do not reflect the nature of things. Lewis Over a century ago James Riddell pointed out that Socrates' defense speech in die Apology closely followed the standard form of Athenian forensic rhetoric. He called the Apology "artistic to the core," and he identified parts of "the subde rhetoric of this defense."1 Since then many scholars have explicated the rhetorical elements in Socrates' defense.2 (...) Their work has led in turn to recent attempts to integrate the rhetorical form into an overall understanding of the meaning and significance of the Apology? The puzzle to be solved is what to make of the fact that Socrates disclaims the ability and the intention to use rhetoric in a speech which is itself a rhetorical masterpiece. R. E. Allen raises the possibility thatby using the techniques ofrhetoric and at the same time denying that he is using them Socrates is dissembling or lying. However, Allen rejects this possibility and interprets Socrates' falsehood as only a surface or apparent falsehood. According to Allen it is ironic parody of a disreputable rhetoric which seeks to convince without concern for the truth.4 For Allen the object of the parody is base rhetoric in general, the type of rhetoric denounced by Socrates in the Gorgias as "rhetoric aiming at gratification and pleasure, and indifferent to truth and the good of the soul."5 Two subsequent articles, one by Kenneth Seeskin, the other by Douglas Feaver andJohn Hare, support the view that Socrates is parodying the debased form of rhetoric. However, they place somewhat different emphasis on the exact object of the parody. They argue that the object of Socrates' rhetorical parody is Gorgias' Pahmedes, rather than pandering rhetoric in general.6 After summarizing the many rhetorical similarities between Gorgias' Palamedes and Socrates' defense speech, Seeskin concludes that "Gorgias' Philosophy and Literature, © 1990, 14: 359-366 360Philosophy and Literature Palamedes is not a masterpiece of world literature; it is a collection of topoi—tried and true devices for winning acquittal... [whereas] despite his disclaimer, Socrates' speech is no amateur performance. On the contrary, he knew all the tricks of the trade and employed them with consummate skill" (p. 97). Seeskin uses Plato's Gorgias to explain how Socrates' rhetoric fits within an overall understanding of the Apology. He notes the two types ofrhetoric presented in the Gorgias: base rhetoric, a species of flattery which aims at gratification; and philosophic or true rhetoric which aims at improving the soul. Then Seeskin makes a crucial point. He insists it is not enough to distinguish between base rhetoric and philosophic rhetoric; there must be a way to identify a given instance of rhetoric as either base rhetoric or as philosophic rhetoric. Moreover, he cautions that distinguishing the one from the other is no easy task. "It is impossible to tell them apart on the basis of technique alone. Base rhetoric is no less polished for its baseness.... Nor can one tell them apart on the basis of their stated goals. Flattery succeeds only to the extent that it can pass itself off as something better" (p. 98). Thus, if Socrates and Palamedes employ the same rhetorical devices, Seeskin wonders how we can tell which type ofrhetoric is in the Apology. "Somewhere in the Apology of Socrates there ought to be a clue which allows one to distinguish his defense from the 'standard' defense composed by Gorgias" (p. 99). Seeskin finds the clue in the exordium, where Socrates denies that he is a skillful speaker: "Unless, of course, by a skillful speaker they mean one who speaks the truth. If that is what they mean, I would agree that I am an orator, though not after their pattern" (17b). Although Palamedes makes a comparable claim, Seeskin argues that Palamedes was concerned with appearance rather than truth, and that the key to appearance is the use of the argument from probability. According to Seeskin, Socrates does not rely on the argument from probability, whereas this argument permeates the Palamedes. The lead-off essay by Kenneth Minogue is an Oakeshottian reflection on the extent to which modern people have become passive spectators of action, detached from traditional loyalties and modes of identity and thus a kind of new Epicurean, shorn of the genuinely contemplative character of the originals. Eric Ormsby follows this with a judicious appraisal of the possibilities and perils for culture associated with the advent of the new information technology. Anthony Daniels provides a similarly sober account of the (...) many consequences and dilemmas of medical technology for the noble Hippocratic art. David Pryce-Jones’s essay recounts the antipolitical utopianism of the totalitarian ideologies that shadowed most of the twentieth century and worries about the potentially destructive utopian tendencies in the contemporary project of European integration. Keith Windschuttle surveys the range of ideologies currently deployed in the academy, most of which derive from vulgarizations of Nietzsche. Edward Said’s influential body of work comes in for particular scrutiny here. Mark Steyn contributes a discussion of the now all-too-familiar self-hatred of Western intellectuals with the blunt precision and wit so characteristic of his splendid newspaper columns. Martin Greenberg’s essay on Burke manages to educe in brief compass the understanding of freedom that is the animating heart of that exemplary statesman’s thought and practice. Diana Schaub makes a case for the importance of political philosophy to the practice of modern politics centered on the statesmanship of Lincoln. He was also the author of the books Convention, Counterfactuals, Parts of Classes, and several volumes of collected papers.

Against Theory is unique in that it puts disparate thinkers from both the analytic and continental traditions into conversation on a central topic in moral philosophy. It also addresses the issue of the impact of postmodernism on ethics, unlike most of the literature on postmodernism which tends to deal with social and political issues rather than ethics. Dwight Furrow's Against Theory is a spirited assessment of two main alternatives to the theoretical approach. One approach, Furrow argues, posits moral life (...) has the form of a narrative and emphasizes the role of historical understanding or imaginative identification in recognizing moral obligation. The second postmodernist alternative, stresses that moral obligation is a feeling of being bound by a presence the source of which cannot be identified through reason or understanding. Furrow's position compellingly negotiates the tension between the living practice of ethics on the one hand, and normative ideals of equality and justice on the other. Furrow questions whether it is possible to resolve this seeming contradition. In doing so, he provides lucidly detailed examinations of such major thinkers as Bernard Williams, Alasdair MacIntyre, Martha Nussbaum, Richard Rorty, Emmanuel Levinas, and Jean-Francois Lyotard. Against Theory 's is a compelling examination of the continental and analytical philosophical ethical traditions. It is widely agreed among broadly Anselmian theists that God is in some sense the 'delimiter of possibilities.' In other words, the scope of possibility is explained by the manner in which the universe emanates from God. However, existing accounts of God's role here—in terms of freedom, choice, or power—face serious difficulties. The present paper provides a new account of God's role as the delimiter of possibilities in terms of the different manner in which the non-actuality of non-actual states of (...) affairs is explained. Intuitively and metaphorically, we can think of the menu of states of affairs being 'whittled down' in successive stages of a process of divine decision-making, with the different species of impossibility corresponding to when and how the states of affairs are ruled out. I argue that this approach provides genuine contingency while also preserving the Principle of Sufficient Reason. (shrink)

This book is a defense of modal realism; the thesis that our world is but one of a plurality of worlds, and that the individuals that inhabit our world are only a few out of all the inhabitants of all the worlds. Lewis argues that the philosophical utility of modal realism is a good reason for believing that it is true.

The term “deep history” refers to historical accounts framed temporally not by the advent of a written record but by evolutionary events (Smail 2008; Shryock and Smail 2011). The presumption of deep history is that the events of today have a history that traces back beyond written history to events in the evolutionary past. For human kinship, though, even forming a history of kinship, let alone a deep history, remains problematic, given limited, relevant data (Trautman et al. 2011). With regard (...) to a deep history, one conjecture is that human kinship evolved from primate social systems in a gradual, more-or-less continuous manner (see Chapais 2008); another conjecture is that kinship, in accordance with the incest account of Claude Lévi-Strauss (1969) or the fanciful, tetradic account of Nicholas J. Allen (1986), “comes into existence with a leap” (Trautman et al. 2011: 176); and yet another, the account to be developed in this paper, is that kinship, as it is understood and lived by culture bearers today, is the consequence of a profound and qualitative evolutionary transformation going from an ancestral primate-like social system predicated on extensive face-to-face interaction to the relation-based social systems that characterize human societies (Read 2012). Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

At the beginning of his Metaphysics, Aristotle attributed several strange-sounding theses to Plato. Generations of Plato scholars have assumed that these could not be found in the dialogues. In heated arguments, they have debated the significance of these claims, some arguing that they constituted an 'unwritten teaching' and others maintaining that Aristotle was mistaken in attributing them to Plato. In a prior book-length study on Plato's late ontology, Kenneth M. Sayre demonstrated that, despite differences in terminology, these claims correspond (...) to themes developed by Plato in the Parmenides and the Philebus. In this book, he shows how this correspondence can be extended to key, but previously obscure, passages in the Statesman. He also examines the interpretative consequences for other sections of that dialogue, particularly those concerned with the practice of dialectical inquiry. (shrink)
